1. Acceptance of Terms
By creating an account, accessing, or using ChatMood, you agree to:
- Be bound by these Terms of Service
- Comply with our Privacy Policy
- Adhere to Twitch's Terms of Service and Developer Agreement
- Be at least 13 years of age (or the age of digital consent in your jurisdiction)
If you do not agree to these Terms, you must not access or use our service.
2. Service Description
ChatMood is a Software as a Service (SaaS) platform that provides:
- Real-time and historical Twitch chat analysis
- Chat sentiment analysis and engagement metrics
- Viewer behavior patterns and insights
- Channel performance analytics
- Data visualization and reporting tools
- Export capabilities for analyzed data
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice.
3. Account Registration and Security
3.1 Account Creation
To use ChatMood, you must:
- Authenticate using your Twitch account
- Provide accurate and complete information
- Maintain and update your account information
- Have only one account per person
3.2 Account Security
You are responsible for:
- Maintaining the security of your Twitch account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized access or security breaches
3.3 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.
4. Subscriptions and Billing
4.1 Subscription Tiers
ChatMood offers the following subscription plans:
Free Plan
- Basic chat analysis features
- 7-day data retention
- Analysis of up to 2 channels per month
- Community support
Starter Plan ($19/month)
- Advanced chat analysis features
- 60-day data retention
- Analysis of up to 20 channels per month
- Alerts (email & webhook)
- Export to PDF & CSV
- Email support
Business Plan ($49/month)
- All Starter features plus:
- 365-day data retention
- Unlimited channels and analyses
- Full API access
- Channel comparison
- Priority support
4.2 Billing and Payments
- Paid subscriptions are billed on a monthly or annual basis (based on your selection)
- Payments are processed by Paddle.com (our Merchant of Record), who handles billing, taxes, and currency conversion on our behalf
- Prices are displayed in USD. You may be charged in your local currency based on your payment method and location
- You authorize Paddle to charge your payment method for all fees incurred under your account
- Prices are subject to change with 30 days' notice to existing subscribers
- Failure to pay may result in suspension or termination of your account
4.3 Cancellation and Refunds
- You may cancel your subscription at any time from your account settings
- Cancellations take effect at the end of the current billing period
- You will retain access to paid features until the end of your billing period

5. Acceptable Use Policy
5.1 Permitted Uses
You may use ChatMood to:
- Analyze public Twitch chat data for legitimate purposes
- Generate insights to improve your content or marketing strategies
- Monitor audience engagement and sentiment
- Create reports and visualizations for internal or client use
5.2 Prohibited Uses
You agree NOT to:
- Violate any applicable laws, regulations, or third-party rights
- Harass, stalk, or harm other users or Twitch community members
- Use the service to collect personal information without consent
- Scrape, mine, or aggregate data beyond the service's intended functionality
- Reverse engineer, decompile, or attempt to extract source code
- Interfere with or disrupt the service or its infrastructure
- Use the service for any automated or bot-driven activities
- Resell, redistribute, or sublicense access to the service
- Upload malware, viruses, or malicious code
- Impersonate others or misrepresent your affiliation
- Use the service to spam, phish, or engage in fraudulent activities
- Violate Twitch's Terms of Service or Developer Agreement
6. Intellectual Property Rights
6.1 Our Intellectual Property
ChatMood and all related content, features, and functionality (including but not limited to software, text, graphics, logos, and design) are owned by us and protected by copyright, trademark, and other intellectual property laws.
6.2 Your Data
You retain all rights to any content or data you input into the service. By using our service, you grant us a limited license to process, analyze, and display your data solely for the purpose of providing our services.
6.3 Twitch Data
All Twitch chat data, usernames, emotes, and related content remain the property of Twitch and its users. We collect and process this data in accordance with Twitch's Developer Agreement and applicable law.
7. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the service will be uninterrupted, secure, or error-free
- Warranties regarding the accuracy, reliability, or completeness of data or analytics
- Warranties that defects will be corrected or that the service is free of viruses
We do not guarantee the availability of Twitch data or the continued operation of Twitch's API. Service interruptions may occur due to factors beyond our control.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DCODER (OPERATING AS CHATMOOD) AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, use, goodwill, or other intangible losses
- Damages resulting from your access to or inability to access the service
- Damages resulting from any conduct or content of third parties on the service
- Damages resulting from unauthorized access to or alteration of your data
OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such cases, the above limitations may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless DCODER (operating as ChatMood) and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to:
- Your use or misuse of the service
- Your violation of these Terms
- Your violation of any rights of third parties
- Your violation of applicable laws or regulations
10. Termination
We reserve the right to suspend or terminate your account and access to the service at our sole discretion, without notice, for conduct that we believe:
- Violates these Terms or our policies
- Harms other users, third parties, or our business interests
- Exposes us to legal liability
- Is fraudulent, abusive, or illegal
Upon termination, your right to use the service will immediately cease. We may delete your account data in accordance with our data retention policies.
You may terminate your account at any time by following the cancellation process in your account settings.
11. Dispute Resolution and Governing Law
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions.
11.2 Dispute Resolution
In the event of any dispute, claim, or controversy arising from these Terms:
- You agree to first attempt to resolve the dispute informally by contacting us
- If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration or in courts located in Brazil
- You waive any right to participate in class action lawsuits or class-wide arbitration
12. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on our service at least 30 days before the changes take effect. Your continued use of the service after changes become effective constitutes acceptance of the revised Terms.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DCODER (operating as ChatMood) regarding the service.
13.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
13.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
13.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.
13.5 Force Majeure
We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or failures of third-party services.
